An accused-friendly provision

There is a provision in the NAB Ordinance that if a person against whom case of embezzlement of any money is proved, deposits a paltry portion of it in the government treasury,  escapes jail punishment and goes Scot free. Many persons including politicians and civil servants who were found guilty of monetary corruption have benefited from it since its promulgation.  Had they been in China they would have faced firing squad. One of the reason why financial corruption doesn’t end in this country is that culprits aren’t given exemplary punishment and escape routes are made available to them to remain out of harm’s way.
The other reason of poor conviction rate in the courts is that the Prosecution branch isn’t pulling its entire weight while pleading its cases in the courts. It doesn’t fight its cases in corruption cases as effectively as it should,  leaving many loop holes with the result that the defence counsels defending the accused exploit the weakness in them leaving no option for the courts but to provide the benefit of the doubt to the accused and set them free.  Unless the Prosecution branch improves its working the conviction rate of the corrupt won’t increase.
